On 07/09/2024, copies of this report were mailed via certified mail to Amy Hernandez. Amy Hernandez was issued a Temporary Suspension Order on 06/10/2024 and the day care is not currently operating.

It was alleged that due to a lack of supervision, a minor living in the home (C1) sexually assaulted a child in care (C2). The licensee self-reported the incident to law enforcement on 06/03/2024. During the course of the investigation, the licensee and other adults in the home were interviewed, children were interviewed, and police reports were obtained. The interviews revealed that the licensee was often inside the home and not providing adequate supervision to children in the backyard. The interviews also confirmed that C2 had been touched inappropriately by C1 numerous times over several months while in the backyard.

Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.
