found comfort on their left side (Note: fracture was in C1’s right forearm). C1 was asleep when P1 arrived, and P1 observed large silent tears coming down C1’s face. Tara Gray, Program Coordinator Jamie Peat, and Teacher Denise Hattam all communicated that something was wrong with C1. The excessive crying and overall fussiness were unusual for C1.
After leaving the center, P1 took C1 to a music class where C1 attempted to crawl twice and her arms gave out causing C1 to collapse on the floor, screaming with large tears. P1 called the medical advice line and was told to bring C1 in. A full body x-ray series showed C1 had a right forearm fracture.
Hospital: Child Abuse & Prevention Specialist, D1, said that the degree of crying could vary, but they would expect fussiness, especially when the arm is being manipulated to put C1 in a highchair or when pressure is put on the arm to crawl. The x-ray showed the fracture was new and there were no signs of healing. It was highly unlikely that C1 could have had the fracture for several days without any symptoms. Based on the onset of symptoms, the fracture likely occurred within the same day, possibly within a few hours before symptoms became apparent.
Based on the interviews and information obtained throughout the investigation, the preponderance of evidence standard has been met. Therefore, the allegation is SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 is being cited on 9099-D page.
