13 | On 9/30/21 at 1:00pm, Licensing Program Analyst (LPA) Emilia Grisak conducted a complaint inspection and met with licensee Vicky Davis. It was alleged that children are instructed to stay outdoors all day, even when hot outside, and specifically that children are also napping outside. The licensee was interviewed on 6/10/21 at 1:00pm and stated that it is an outside facility and everything is set up for the children outside and parents are aware they are outside all day and they are all ok with it. Licensee stated that if it is hot then they play in the sprinklers and use water toys and she has shade and tents set up. Three parents were interviewed on 6/24/21, 6/30/21, and 7/6/21. It was stated during a parent interview that child wakes up hot and sweaty from napping outside. During tele-inspection on 6/10/21 LPA observed two children sleeping in small pop-up tents on a sidewalk in direct sunlight. LPA observed that the recorded temperature for 6/10/21 was 75 degrees F. Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.
