13 | Licensing Program Analysts (LPAs) Jyoti Saini and Diana Campos arrived unannounced to deliver the findings from a complaint investigation for the above allegation. LPA met with Director Sarah DeSousa and explained the purpose of the inspection. Present during the inspection, director and three staff members supervising 9 infants.
Based on interviews and record reviews, LPAs determined that the child (C1) was placed directly to sleep on their stomach by staff for approximately 1–2 minutes. Based on the video footage provided, the LPAs determined that although the staff remained present with the child, Title 22 regulations require that infants under 12 months of age be placed on their backs to sleep unless a valid medical exemption is on file. The preponderance of evidence standard has been met; therefore, the allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, Section 101430(a)(3)(A), is cited on the attached LIC 9099D. |
