On 09/18/2026, Licensing Program Analysts (LPAs) Dana Santiago and Nicole Reynoso conducted a subsequent Complaint Investigation at Children’s Workshop Oakland. LPAs met with Director, Jessica Spenchian and explained purpose of investigation. During today's inspection, there were 5 toddlers and 17 preschool children in care with 5 staff including director on site. Director stated there are 29 children enrolled. The finding for the above allegation was delivered during the inspection. Complainant alleges that Staff are commingling the day care children. During the course of the investigation, LPAs inspected the facility, reviewed documents, observed classroom practices, and conducted interviews. Based on interviews and evidence obtained it was determined that children enrolled in the Oaks class (Child Care Center) and the Seedlings class (Family Child Care Home) have shared the "auxiliary campus yard" located in the neighboring family child care home during weekly outdoor play. It was revealed that this practice has been occurring since Fall of 2025 or earlier. It was further determined that the Oaks and Seedlings classes have been routinely combined during the late afternoon pick-up period from approximately 4:30 PM to 5:30 PM. Both classes are licensed under separate facilities, and commingling of children occurred in areas not approved under the center’s license.----Report continues on 9099c page 2-------------

During the course of the investigation, LPAs inspected the facility, observed classroom practices, reviewed documents, and conducted interviews. Based on interviews and evidence collected it was determined that staff have been using an unlicensed location, not under the center's plan of operation to provide care for daycare children. On July 29, 2026, at approximately 10:10 AM, stafs identified as S4, S5, and S6 from the center were observed in the "auxiliary campus" area with children were enrolled in Oaks and Acorns classes from the center. The auxiliary campus is located within the neighboring Family Child Care Home (FCCH), which is not licensed under the center.

Interviews and evidence collected revealed that since Fall 2025, and possibly prior, the Oaks class has regularly spent time in the shared yard located on the auxiliary campus from approximately 9:45 AM to 10:40 AM. Staff also stated that Oaks has lunch in the shared yard from approximately 12:00 PM to 1:30 PM, has afternoon snack in the same area from approximately 3:00 PM to 4:30 PM, and utilizes the FCCH area during pick-ups for the Oaks class.

Additionally, it was revealed that the Acorns class, registered under the Child Care Center, participates in activities within the FCCH premises during mid-mornings from approximately 10:45 AM to 12:00 PM on Mondays, Thursdays, and Fridays. These practices show that children enrolled in the center are receiving care in an unlicensed location not approved under the Child Care Center’s license. Therefore, the allegation is substantiated. California Code of Regulations, Title 22, Division 12 is being issued a Type B citation on 9099-D page as this is a potential risk to health and safety to children in care.

Exit interview was conducted with Director, Jessica Spenchian. Appeal rights were provided.

A NOTICE OF SITE VISIT WAS ISSUED AND MUST BE POSTED FOR 30 CONSECUTIVE DAYS.
