32 | Licensee ensures that children in care are supervised at all times and is aware children shall not be left in parked vehicles. The outdoor play area in the backyard is fenced and there are no hazards to children present. LPA observed a trampoline in the backyard. According to the licensee’s policy and the trampoline waiver, children are permitted to use the trampoline one at a time. However, during the inspection, LPA observed three children jumping inside the trampoline simultaneously. LPA discussed these observations with the licensee and reviewed her stated policy. The licensee has 1 dog that is inaccessible to children. The licensee is aware of child safety around pets and accepts responsibility for any action taken by pets. Capacity as specified on the license is being maintained.
LPA reviewed a sample of children’s files and observed files were complete with emergency information as required. The licensee has not renewed her mandated reporter training certificate since 05/20/24, which poses a potential health, safety, or personal rights risk to persons in care. LPA will issue a Type B citation. The licensee recently hired an assistant who has not yet completed the mandated reporter training. The assistant’s first day of employment is today; therefore, she has 90 days from her start date to complete the required training. Licensee’s pediatric CPR/First Aid certification expires on 08/16/27. A review of records indicates that all employees and/or volunteers have immunization records on file for influenza, pertussis and measles. LPA observed that the assistant has not completed a current tuberculosis (TB) assessment. LPA explained to the licensee that the assistant must complete the TB requirement within seven days of employment. The assistant provided an immunization record; however, the TB test on file was dated 2024 and is no longer current.
LPA discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to resources such as forms, regulations Provider Information Notices (PINs), and Quarterly Updates. LPA discussed Reporting Requirements as outlined in the regulations (Section 102416.2).
Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.
Based on observation, interview, and record review, the licensee did not comply with the section cited above. LPA found two infant safe sleep logs to be incomplete, and no additional logs were provided despite four infants being in care. This poses a potential health, safety, or personal rights risk to persons in care. LPA will issue a Type B citation.
