On 10/09/2026, Licensing Program Analyst (LPA) Evelyn Garcia met with Rocio Gomez for the purpose of conducting additional interviews and delivering findings regarding the complaint investigation and allegations noted above. Upon arrival, LPA conducted a tour of the facility and verified a census of 53 children, with 11 staff members providing care and supervision. All adults had been fingerprinted and cleared.

During today's investigation, LPA gathered additional evidence relevant to the complaint. The investigation consisted of interviews with children, staff, and relevant parties, as well as document reviews. The interviews revealed that although Staff #1 raised her voice at a child, she did so out of concern that the child was going to fall and get hurt. The interviews did not indicate that the volume or tone of her voice was intended to intimidate or threaten the child. In addition, the interviews revealed that the slapping sound heard by the Reporting Party (RP) was Staff #1 slapping her own thigh to get the child's attention after seeing him on the planter. There was no evidence that Staff #1 pulled the child by the shirt to make him sit down.

Interviews further revealed that although there had been reports of staff using harsh tones with children or parents, there was no evidence to support that such conduct occurred during this incident. Staff #2 stated that training had been provided to address the previous concerns and that the staff member's performance had improved, with no recurring incidents reported since the training.

Based on the information obtained and LPA's observations and interviews, there are inconsistent statements about the above allegations and have been deemed unsubstantiated. A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.

An exit interview was conducted. A copy of this report, the Notice of Site Visit, were provided to Site Director Rocio Gomez.
