Licensing Program Analyst (LPA) Nolan Tcheng conducted an unannounced Case Management inspection to follow up on an incident submitted to the Department on 09/21/2026. Upon arrival at 8:50am, LPA met with Facility Representative Gwen Blackmon. A tour of the facility was conducted and census was taken. There were 10 children with 4 staff members.

On 09/17/2026, facility was notified from Parent #1 (P1), that on 09/15/2026 they had observed Staff #1 (S1) with Child #1 (C1). Child #1 was screaming and crying, and P1 states they observed S1 grab and pull C1 towards them. During today's inspection, LPA conducted interviews with four staff members and one parent. Documentation in the form of email written statement from Parent #1 was obtained.

LPA conducted a phone interview with S1, who stated that C1 is a newer child to the facility and they are still getting use to eating and drinking on their own. S1 explained that they had taken C1 to the kitchen during naptime in order to get them a snack because they were upset and crying. Per S1, "I asked if the child wanted milk. The chairs in the kitchen are high and [they are small]. I picked [them] up and gave [them] a hug and told [them[ it was okay. [C1] was on my lap and I was giving [them] milk to drink. [C1] only takes sips at a time. I guess [Parent #1] that was there said that I was forcing it. [C1] took a sip and that was it." LPA interviewed Parent #1, who disclosed that in the kitchen they had observed S1 grab C1 and "yanked them really hard" towards them. P1 says that after the pull, S1 " wrapped [them] up and tried to give [them] water. [C1] was crying so loud."

LPA spoke with Staff #3 about what S1 shared with them. "S1 did admit that [they] grabbed the child in a manner that would have been considered fast. [They] grabbed him by one arm and by the bottom. [C1] was on a chair and [their] feet were dangling, and brought [C1] to [S1's] lap because [they] were crying nonstop. They were conforming [C1]. [C1] only takes sippy cups and bottles. [They] did put water in C1's] mouth using a cup." REPORT CONTINUES PAGE 1 of 2

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

LPA conducted interview with Staff #3 (S) who works with S1 and C1. S3 corroborated that C1 is still getting use to the facility and class. They shared that C1 still gets upset a lot and they have been trying to work on getting them comfortable at the facility. The also corroborated that child is learning to eat by themselves and that they are practicing on normal cups when it comes to drinking. Staff #3 also adds that they are getting use to their emotions. Interview with Staff #4 made no disclosures regarding the incident.

LPA reviewed email statement from Parent #1. The statement corroborates the situation observed with S1 grabbing C1 and pulling the child towards them. It continues to describe S1 holding the child's face and attempting to make C1 drink from a small cup. Child was described as crying and unwilling to drink. Email continues to emphasize the force in which P1 observed S1 use on C1's arm.

In review of the interviews and written statement, there was conflicting information on how hard S1 pulled C1 towards them and if S1 did try to force the child to drink from a cup. The child was corroborated as being very upset and of nonverbal age. S1 specifically brought the child to the kitchen room in order to get them a snack and something to drink to see if it would help C1 calm down. The interviews did determine that Staff #1 did pull Child #1 towards them in order to have them drink from a cup, but though the manner was disclosed as "fast," it is unclear how hard. Based on the information gathered, this is a violation of Personal Rights as child was physically pulled towards S1 to drink from a cup. There was no reported injury to Child #1.

The deficiencies listed on the following pages were observed by the LPA and are being cited in accordance with California Code of Regulations Title 22. Please see attached LIC 809D for deficiencies that are being cited and need to be cleared to protect the children’s health & safety.

A notice of site visit was given and must remain posted for 30 days.

Exit interview conducted and report was reviewed with Facility Representative Gwen Blackmon, at 12:20pm. Copy of Report provided.

Based on interview and record review, Licensee did not ensure that Child #1's personal rights were protected when Staff #1 grabbed and pulled C1 to them in a fast manner, to have them drink from a cup. This is a potential risk to the health, safety, and personal rights of children in care
