Licensing Program Analyst (LPA), T. Tran arrived at the above licensed facility to conduct an unannounced subsequent complaint inspection for the purpose of concluding the investigation of the above allegations. Upon arrival, LPA met with licensee Bobbie Mays, her employee and observed two children in care.
Based on records review and interviews were conducted. On 4/6/2023, no employee file was reviewed during the visit due to licensee failed to obtain an employee (A2) file. During an interview, A2 admitted back in 2020, A2 had posted a picture of a daycare child on Instagram and shared with child's mother. Therefore, based on the preponderance of evidence, the daycare had failed to maintain record of current employee and also children personal rights was violated by posting a daycare child on instagram without the document of the parent consent were substantiated. A finding means that the complaint is substantiated and the allegation is valid because the preponderance of the evidence standard has been met.
Facility was cited type B deficiencies. Please see Complaint Investigation Report LIC 9099D for deficiency cited. A notice of site visit was given and must remain posted for 30 days.

This requirement is not met as evidenced by based on interview and record review licensee failed to protect a daycare child's personal right by allowing A2 posted a daycare child picture on instagram which poses a potential health and safety risk to children in care.

Licensing Program Analyst (LPA), T. Tran arrived at the above licensed facility to conduct an unannounced subsequent complaint inspection for the purpose of concluding the investigation of the above allegations. Upon arrival, LPA met with licensee Bobbie Mays, her employee and observed two children in care.
Based upon the evidence obtained during the course of the investigation through interviews, record reviews, and observation, the evidence does not support, nor disprove the above allegations of the provider was under the influence of alcohol while caring for daycare children and the provider made threat and imitated children when interacting with them occurred at the facility. Therefore, the allegations have been determined unsubstantiated. Unsubstantiated – A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.
A notice of site visit was given and must remain posted for 30 days.
