IB investigator Santana interviewed former facility clients who revealed that children in care have been in close contact with Adult 1 in areas of the facility that have been labeled as off limits on the facility sketch. Interviews conducted with current children confirmed being in the garage with Adult 1 watching movies despite the Licensee stating the garage has always been off-limits. In addition, the parent of one formerly enrolled child observed their child in a bedroom alone with Adult 1 watching television while the Licensee was elsewhere with other children in care. The Licensee acknowledged Adult 1 has interacted with children in care in the past, but she denied knowledge of inappropriate interactions. Adult 1 declined to provide a statement even though he was given the opportunity to have an attorney present, upon his request.
IB investigator Santana found that Child 1 was consistent in their disclosure to their parents, an LASD Deputy, the forensic interviewer from the Children’s Advocacy Center and was credible in their extensive detail. The preponderance of evidence standard has been met; therefore, the above allegation is found to be Substantiated.
California Code of Regulations, (Title 22, Division 12, Chapter 1), are being cited on the attached LIC 9099D.
Adult 1 is identified on Confidential Names form (LIC811) and provided to Licensee.
The notice of site visit was posted where the parent/guardian of children enter and exit the facility.
A copy of this report shall also be posted where the parent/guardian of children enter and exit the facility. Both the notice of site visit and licensing report shall remain posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon their return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled child for the next 12 months. A signed Acknowledgement of Receipt (LIC9224) shall be in each child’s file, acknowledging receipt.
A Non-Compliance Conference is scheduled for February 21, 2024. Licensee was also advised that a copy of this report will be provided to the Resource and Referral Agency per an agreement between CDSS and the R&R network.
Exit interview conducted and a copy was given to the Licensee Concepcion Ruiz.
