An unannounced inspection was conducted by Licensing Program Analyst (LPA) Roxana Lopez on 9/22/2026. The purpose of this inspection is to provide the findings of the complaint investigation which was received on 7/27/2026. LPA met with, Armando Inclan- Principal to whom the purpose of the inspection was announced. Census was taken. Per Principal, there are 67 children enrolled.

Throughout the course of the investigation, interviews were conducted with staff, and parents. LPA also reviewed and obtained copy of children’s roster and other documentation.

Per initial complaint report, the Reporting Party (RP) reported that the facility was discriminating against child in care. During interview, with RP (language services was used Badge # 63-464089) they disclosed that child # 1 was not allowed to come to the facility- earlier or picked up later than schedule. Per RP, they have not been allowed to change their schedule, and facility is asking for “personal” information. RP disclosed that they feel that administration is discriminating against them due to language barriers. --- pg.1 of 2 ---

LPA conducted interviews with Staff- staff corroborated that all children have an individualized set scheduled that needs to be followed. Per Staff # 1, they have the necessary staff to meet ratio needed during the schedules. Therefore, children are not allowed to come to the facility early or stay later. Staff corroborated that if there is an emergency or prior communication, they might be able to work something out, but if it is something ongoing they ask for a request for the hours to be changed to be submitted. Per staff, along with the request, authorize representative need to submit proof of their needs and other documents such as pay stubs. Per staff # 1 and # 2 they have not denied entry or change of schedule to a child due to discrimination. Staff corroborated that if they are not able to communicate with families in their language they look for a staff member that is able to communicate with them- however they do have a language service they can use if needed and some families communicate through their cell phones.

LPA conducted interviews with parents. 4 out of 6 Parent’s statements corroborate that they have no concerns with administration or with the contract hours. 2 out of those 4 parent’s stated that they are strict with arriving on time but they didn’t have any issues. 2 parent interviews corroborated that they had concerns with friendliness and “maybe discrimination” from the administration staff- as they were late once.

This agency has investigated the complaint alleging facility was discriminating against child in care. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated.

No deficiencies cited for this report/allegation. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the facility representative Armando Inclan.
