32 | During the investigation, LPA requested and reviewed the following documents: Children’s Roster, Children’s Files, Lawndale Preschool Pick Up Authorization Form, Sign In and Sign Out Logs from January 2026 to April 2026, Internal Report, Electronic Correspondence within LESD, and the California Department of Education Early Education Notice of Action (CD 7617). Additionally, LPA conducted interviews with all relevant parties.
Based on interviews and documentation obtained, it was determined that the authorized representative was denied access to the child (C1) and to the child’s records. Record review showed that the father was listed on both the Lawndale Preschool Program Pick-Up Authorization Form and the Lawndale Elementary School District Student Emergency Form. Furthermore, staff interviews and review of C1’s file revealed that there was no written documentation indicating that the father was restricted from accessing C1’s file, nor was a certified copy of a court order provided. This constitutes a violation of Section 101221(e) – Child’s Records, which requires that a child’s records be open to inspection by the child’s authorized representative. This is a Type B violation.
Based on record review, interviews, and all evidence obtained, it has been determined that staff did not provide an authorized representative access to a daycare child’s records. The preponderance of evidence standard has been met; therefore, the allegation is SUBSTANTIATED.
Pursuant to Title 22, Division 12, Chapter 1 of the California Code of Regulations, one (1) deficiency is cited for violation of Title 22 requirements. This deficiency is documented on the LIC 809-D.
An exit interview was conducted, and Plans of Correction were reviewed and developed with Director Tia Belt-Brown. A copy of this report and appeal rights were discussed with and provided to the Director. A Notice of Site Visit was issued and must remain posted for 30 days. Failure to comply with posting requirements will result in an immediate civil penalty of $100.
