32 | During the interview, the Director stated that all parents/guardians are provided with a complete copy of the Stipulation, Order, and Waiver and Second Amended Accusation for review and are required to sign form LIC 9224 Acknowledgement of Receipt. The Director stated that the signed LIC 9224 is maintained in each child's file, while the parent/guardian retains the copy of the Stipulation, Order, and Waiver and Second Amended Accusation. The Director also stated that all new families receive the document during the enrollment process, prior to the child's admission.
The LPA conducted a file review at the facility. LPA observed the Director open the file cabinet and provide access to each enrolled child's file. LPA reviewed the files of all currently enrolled children and observed a signed LIC 9224, Acknowledgement of Receipt form, documenting receipt of the Stipulation, Order, and Waiver and the Second Amended Accusation in each file. The LPA compared the signatures on the LIC 9224 forms with signatures on other licensing documents contained in the files and found them to be consistent.
The LPA also obtained and reviewed a copy of the facility's enrollment packet. The enrollment packet included a summary page attached to the Stipulation, Order, and Waiver and the Second Amended Accusation along with the other required enrollment documents.
LPA interviewed one parent/guardian from each enrolled child's household. Parent/guardian statements were inconsistent regarding the allegation that the facility failed to provide the Stipulation, Order, and Waiver and Second Amended Accusation.
Based on interviews conducted and observations made during the investigation, there is insufficient evidence to support the allegations that the facility failed to meet reporting requirements by not providing parents/guardians with a copy of the facility's Stipulation, Order, and Waiver and the Second Amended Accusation. Although the allegations may have occurred or may be valid, the evidence obtained does not meet the preponderance of evidence standard necessary to prove that a licensing violation occurred. Therefore, the allegations are determined to be Unsubstantiated.
A Notice of Site Visit was provided and must remain posted for 30 days during the hours of operation following each site visit by a licensing representative. Failure to maintain the posting as required may result in a civil penalty of $100. An exit interview was conducted with Director, Tara Perera and appeal rights were provided.
