Licensing Program Analysts (LPAs) Jeanette Estrada and Elka Chavez conducted an unannounced case management visit at the facility for the purpose issuing deficiencies based on record review. Upon arrival LPAs met with Facility Representative, Destiny Stowe (Staff 1) who informed LPAs that Director Yolanda Stowe was not present but would be arriving soon. LPAs observed Staff 2 in the proposed infant room with 3 children. About 2-3 minutes later, one of the infant children was walked over to the preschool room where LPAs observed 3 children with Staff 3. Director arrived about 20 minutes later and LPAs informed her of the reason for the visit.

On 7/24/26 and 8/20/26 facility was issued a type B deficiency for regulation 101161(a) Limitations on Capacity due to the date of birth for Child 1 not being verifiable on forms in the child's file. The date of birth on multiple forms had been crossed off and altered to appear that Child 1 was 2 years old at the time of those visits. Director submitted a birth certificate for Child 1 on 8/26/26. Upon review of the birth certificate, it was confirmed that Child 1 is not currently 2 years old therefore they cannot be enrolled in the preschool program. Child 1 was observed in the preschool program during visits conducted on 6/18/26, 7/24/26, 8/20/26 and today 9/21/26. This is an immediate risk to the health and safety of children in care.

LPAs advised Director that although they have submitted an application for a proposed infant component (license # 198401389), it has not been approved by the Department and no infant children shall be present. Child 1 was observed present at the facility in the proposed infant room and the preschool room during today's visit. The proposed infant room is still currently licensed under the preschool license.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

The license with the proposed infant component 198401389 has not been issued. In addition to Child 1, LPAs observed Child 2 and Child 3 in the proposed infant room while Staff 2 was providing care. Child 2 and Child 3 were also confirmed to be infants under 2 years old. This is an immediate risk to the health and safety of children in care.
LPAs reviewed staff files due to observing Staff 2 providing care to the infants present today. On 7/24/26 LPAs issued a type B deficiency for regulation 101217(a) Personnel Records because there was no complete file for Staff 2 who was also providing care to preschool children that day. For this citation, Director submitted a declaration stating that Staff 2 would no longer be providing care. Director stated Staff 2 would be the cook for the facility. During today's record review, it was confirmed that the file for Staff 2 is still incomplete. Whether staff 2 is a teacher or a cook, a complete file is required. This is a potential risk to the health, safety and personal rights of children in care and a repeat violation.
Upon record review, it was also confirmed that Staff 2 is currently enrolled in classes to comply with education requirements for the position of Teacher or Infant Teacher (not a fully qualified teacher).

LPAs advised Director that Child 1, 2 and 3 could not be present until an infant license is issued as determined by the Department. LPAs observed that Child 2 was picked up from the facility at 11:29 AM. Child 1 was picked up at 12:20 PM. Child 3 was picked up at 1:02 PM.

During the visit, Director informed LPAs that Child 4, present in the preschool classroom upon LPAs arrival was enrolled in the school age program.

Today, LPA will be issuing two type A deficiencies for regulation 101161(a) Limitations on Capacity and Health and Safety Code 1596.885(c) Denial, suspension or revocation of license, registration, or special permits; grounds and one type B deficiency for regulation 101217(a) Personnel Records. This is a repeat violation therefore a civil penalty of $250 will be issued on form LIC 421FC.
