During this investigation LPA M. Garcia obtained copies of Children’s roster dated 06/01/2021, updated LIC 279, death certificate for Licensee George Mauney, review staff records, conducted interviews with Licensee, one (1) day care staff, one (1) former day care parent and three (3) parents of currently enrolled children who attend facility. LPA attempted to interview one (1) other staff.

Pertaining to the allegation of Licensee is not present for a significant amount of time interviews with Licensee and one day care staff all reveal that Licensee leaves the day care to drop off children to school in the morning. Interview with parents all reveal that in the time attending day care parents have seen Licensee present at the day care and denied Licensee not being present for a significant amount of time.

During the inspection conducted on December 06, 2021, Licensee was not present upon LPA’s arrival in the morning however, Licensee later arrived during LPA's inspection disclosing that she was dropping children off at school.

Regarding the allegation that adults do not meet the minimum requirements for licensing, LPA Garcia verified using data base Licensing Information System (LIS) that Staff #2 & Staff #3 are both fingerprinted cleared and associated to the facility. In review of records, LPA Garcia verified current Pediatric First Aid and CPR from the American Red Cross for Staff #2 & Staff #3 and certificate of completion for California Child Care: Preventative Health and Safety course dated 08/16/15 for Staff #2. Immunization records for Staff #2 & Staff #3 were reviewed and are on file.

Referring to the allegation of adults are unable to communicate effectively with daycare children, interviews with day care staff reveal day care assistants are Chinese Mandarin and Cantonese speakers. Four (4) day care parents interviewed reveal that all day care staff can communicate effectively with their children.

Based on the interviews conducted and records review, at this time there is not enough evidence to support the above allegations.

This agency has investigated the complaint alleging that Licensee is not present for a significant amount of time, adults do not meet the minimum requirements for licensing and adults are unable to communicate effectively with daycare children. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore at this time the above allegations are deemed unsubstantiated. Should additional information become available in the future, this investigation may be reopened.

A notice of site visit was given and must remain posted for 30 days.

Exit interview conducted and report was reviewed with Licensee, Lily Mauney.
