two different occasions and documents prove that C1's arm was fractured, no witnesses accounts support that both incidents were caused by a lack of supervision.
Facility did not report incident to Authorized Representative
Based on the information obtained during the investigation, the allegation that the Facility did not report incident to Authorized Representative is unsubstantiated. LPA conducted interviews with staff parents and reviewed incident reports for C1. Three out of five staff stated that when children are injured at school, it is standard procedure to contact the parent. Two out of two parents interviewed agreed that the facility routinely contacts them when their child is hurt.
LPA reviewed incident reports signed by the parent and observed that the incidents involving C1 were signed by the authorized representative on the day the incident occurred. Additionally, for one of incidents, the facility reported the incident to the Department the following day and stated the parents had been notified.
Child was not provided comfortable accommodations after sustaining an injury while in care.
Based on the information obtained during the investigation, the allegation that child was not provided with comfortable accommodation after sustaining an injury while in care is unsubstantiated. LPA conducted interviews with staff and reviewed reports related to the incident involving C1. Staff 1 (S1) stated after providing an ice pack and waiting for some time C1 initially seemed fine; however, after some time passed, S1 noticed that C1 was not using their arm. Staff 6 (S6) reported that they observed C1 after the incident and noticed a change in their behavior. Per S6, this prompted them to notify their supervisor to contact C1's parents.
According to S1, C1 did not immediately display signs of discomfort, and staff did not initially observe behavior indicating the need for additional accommodation. Shortly after the incident occurred S1 and S6 observed that C1 was not using their arm, they responded by notifying the parent for the second time. Per facility representative, the incident, parent phone call, observation, second phone call, and pick up happened within approximately one hour and 50 minutes. The evidence provided does not support the allegation. |
