Licensing Program Analyst (LPA) Warren Birks conducted an unannounced complaint inspection to investigate the above allegation. LPA met with Licensee Jessica Delmar who assisted with the investigation. Licensee and two fingerprint cleared staff were caring for eight preschool and three infant children.

At 9:00am LPA observed parent check in which children were received by childcare staff. At 9:15am LPA observed children eating a morning snack on their mats in the backyard driveway area. At 9:45am LPA conducted interviews with child #5 and child #6. During the course of the investigation, LPA attempted interviews with six children (Three of five children were qualified to intervew and one was unavailable).

LPA received no disclosures (from children or staff) indicating that children were left unattended at the facility. LPA also made an observation that Teachers occasionally sit in areas (2 feet from children during snack time) that appear out of view from the front of the house. LPA received no other information that corroborates the allegation. CONTINUED

In addition to information obtained from the investigation; LPA also took into consideration the following:

1. The Licensee has two (2) assistants and on three occasions LPA observed the facility to be well within ratio with all three (3) staff caring for less ten children

2. The threshold for care and supervision at a Family Childcare Home does not necessarily require 100% visual supervision while children are in care .

Although the above allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur. Therefore, at this time the above allegation is Unsubstantiated.

Note: LPA also interviewed children and staff regarding a minor non-medical injury to child #1. Staff #2 indicated they witnessed the incident firsthand in which child #1 didn't use his footing well when climbing a small brick area (less than 2 ft high). As a result the child sustained a small non-emergency scratch. There was no other information available in regards to this incident.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Appeal Rights provided and explained.
