LPA met with Maria Espinoza, Licensee's Assistant who let the LPA into the facility. The Licensee, Roxana Mendoza, was not present at the time of arrival. Upon entrance to the facility LPA observed 3 children in the living room. LPA asked Ms. Espinoza how many children were present and she stated 10. LPA then asked to see the other children, whom Ms. Espinoza indicated were in the bedroom. The door to the bedroom was closed. LPA then observed 07 children in the bedroom both asleep and awake in play yards and cots. LPA advised Ms. Espinoza to leave the door to the bedroom open. The facility is currently out of ratio with Ms. Espinoza being present with 10 children. Licensee's assistant is unaware of what they day care hours are.

Family members residing in the home are the Licensee (criminal record clearance on file) and 1 child. This is a one story home which consists of 2 bedrooms, 1 bathroom, kitchen, laundry room, living room and front and backyards (fenced). There is one bedroom that is off limits. The children use the front yard for outside play. The children do not have access to the back yard which is only used for tenant parking.

Areas accessible to children were inspected to ensure that they are clean and orderly with ventilation and heating for safety and comfort. There are toys available for children. LPA observed an infant rocker chair in the living room, LPA advised assistant that this item is not allowed. There is a wall ac and a wall heater which is inaccessible. There is a working telephone service maintained in the home. Detergents, cleaning compounds, medications, and other items which can pose a danger to children are accessible in the kitchen. At approximately 1:10 PM LPA observed kitchen knives on the kitchen counter utensil cylinder, as well as boxes of Mexican medications (photo taken), both were accessible to children in care; this is an immediate risk to the health and safety of children in care. Currently children use front yard for outdoor play. The outdoor play area was observed to be fenced. LPA observed that the outdoor yard has toys and other materials for children to play with. LPA did not observe any objects that could be hazardous to children in care.

LPA observed the following required posted documentation in the main entry way of the facility: Facility License, Publication (PUB) 394- Notification of Parent Rights and Licensing Form. LPA reviewed facility records for LIC 9040- Facility Roster, LIC 610- Facility Disaster Plan and Disaster drill log, last drill documented was 09/13/22. Licensee's assistant states that there are currently 14 children enrolled, children's roster was reviewed.

Licensee states that there are no poisons stored in the home and understands that all poisons must be lock, not only inaccessible to children. Isolation area for sick children waiting to be picked up is in one of the bedrooms if necessary, away from the other children. Per Licensee there are no firearms or weapons stored in the home.

Infant Care: The facility is caring for infants under 12 months, however, none are present on this date. LPA informed licensee of the new Safe sleep regulations, including LIC 9227 Infant Sleep Plan for infants under 12 months, 15-minute sleep check documentation for infants 0-24 months.

Children’s records were not available for review during this inspection. Licensee's assistant was not aware of where the files are located. This is a potential risk to the health and safety of children in care.

Staff records were reviewed for approved Pediatric First Aid and CPR certification, the Licensee's certification expires 08/2023, the Licensee's Assitant's expires 04/2024. LPA reviewed the LIC 508- Criminal Record Statement, Proof of immunization's against measles, pertussis and influenza or influenza declination, TB clearance or risk assessment, LIC 9108- Statement Acknowledging Requirement to Report Child Abuse and current Mandated Reporter Training Certificate, certificates are dated 05/12/22 and 06/10/21.
