On 2/23/2024, Licensing Program Analysts (LPAs) Carolyn Tuba and Jessica Hopkins-Hernandez conducted an unannounced complaint inspection to deliver findings of the above allegations. LPA, Tuba conducted interviews, personal observations, and reviewed records on 11/29/2023, 01/10/2024 and 2/23/2024. LPA, Tuba conducted interviews with Reporting Party (RP), Licensee (L), Staff #1 (S1), Child #2 (C2), #3 (C3), #4 (C4), #5 (C5), Witness #1 (W1) and Witness #2 (W2), Parent #1 (P1), #2 (P2). Provider yells and speaks to daycare child an inappropriate manner: LPA interviewed Licensee and S1 who denied that children were yelled at. According to Licensee, she uses a calm voice only an emergency or if a child is about to hurt themselves. S1 denied that children were yelled at but would at times raise their voice if children were in some danger and stated that Licensee may use a firm voice. LPA interviewed P1, P2, C1, C2, C3 and C4 who made no disclosures regarding staff yelling at the children.

LPA interviewed W2 who denied that children were yelled at but recalled Licensee speaking to C1 in a “harsher” and “scolding” tone. W2 stated that C1 would be spoken to in such a way as C1 would get into trouble. W2 also stated that C1 wasn’t always in trouble but would get spoken in the tone described. According to W2 the tone did not match with the philosophy of the daycare.

Therefore, the allegation has been determined to be unsubstantiated. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.

Notice of site visit was given to the licensee and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.

Exit interview conducted and report was reviewed with the licensee, Christine Martinez.
