On 09/28/26 at 11:30am, Licensing Program Analyst (LPA) Diana Ortiz conducted an unannounced site inspection to deliver the findings regarding the above complaint allegation. LPA met with Director, Teresa Fuentes, who was informed of the purpose of the visit. LPA was guided on a tour of the facility, and a census was taken, during which 47 children and seven (7) staff were observed present. Per Director, there are currently 80 children enrolled.

As part of the investigation, LPA interviewed Director, eight (8) staff members, and five (5) parents including parent of Child #1 (C#1). LPA obtained and reviewed copies of the Personnel Report (LIC 500), Facility Roster, Parent Handbook, four (4) inhouse Incident reports for C#1, staff schedules, copies of several staff timecards, and Classroom Daily Ratio Attendance Tracking Forms for July 9, 2026, and July 10, 2026. LPA also reviewed a random sample of children's and staff files. Reporting Party (RP) was not interviewed due to the complainant being anonymous and no contact information was given.

Allegation 1: Staff not preventing daycare child from pushing other children.

The Reporting Party (RP) stated that the Director places approximately 3-year-old children in the Toddler 2 classroom with children approximately 1.5 years old. RP stated that one of the older children may have special needs and has been pushing other children, which the RP described as a safety hazard. RP reported that teachers have attempted to discuss separating the older children from the younger children with the Director, however, the teachers’ concerns were allegedly dismissed.

Director stated that Toddler 2 classroom serves children from 18 months until approximately 2½ years old. Per Director, a 3-year-old child remained in the toddler classroom because he was scheduled to leave the facility at the end of the month and did not want to put him in a different environment. Director stated she was not aware of Child #1 (C#1) displaying aggressive behavior toward other children. C#1 last day at the facility was on 07/24/26. Director reported no staff concerns regarding safety or supervision, other than concerns raised by two teachers regarding the timing of moving children between classrooms.

Staff #2, #3, #5, #7, and #8 provided consistent statements regarding C#1’s challenging behaviors, including pushing or hitting other children, throwing toys, climbing on furniture, and tantrums. Staff reported that C#1 requires reminders, increased supervision, and at times one-on-one attention. Overall, the staff statements were consistent regarding C#1’s need for additional supervision and support with behavior.

Parents #1-#4 interviewed stated that they do not have any concerns regarding the facility or staff and reported satisfaction with the care provided.

Parent #6 stated that C#1 no longer attends the facility because the family relocated to Texas. Parent #6 reported that C#1 last attended the facility during the last week of July.

During the course of the investigation, LPA conducted interviews with staff and reviewed four (4) in-house incident reports pertaining to C#1, dated 04/20/26, 05/26/26, 06/19/26, and 07/02/26.

Allegation 2: Classroom operating out of ratio.

The Reporting Party (RP) states that the Toddler 2 classroom is consistently over the required child-to-staff ratio. RP stated that children from other classrooms are placed in the Toddler 2 classroom, resulting in the classroom being over ratio.

Director stated that Toddler 2 maintains a 6:1 teacher-child ratio and that management monitors ratios throughout the day using daily sheets. She reported that Toddler 2 averages approximately 15–18 children per day and that additional floating staff are available to assist when needed. Director stated she was not aware of any recent instances in which the classroom exceeded ratio. Director reported that staffing schedules are staggered to maintain coverage and stated that she believes the facility has adequate staffing.

Staff #1 stated that the classroom typically has approximately 18 children with 3–4 staff and reported no instances of being out of ratio. Staff #2 and Staff #3 reported that one instance the classroom was out of ratio during morning drop-off, with approximately 19 children and 3 staff, and stated that management was notified and additional staff were sent to assist. However, a date was not provided. Staff #4, Staff #5, Staff #6, and Staff #7 reported no known instances of being out of ratio and stated that additional staff are provided when needed. Staff #8 stated that ratios are monitored through classroom counts and management checks, with additional staff available to assist. All staff stated that management and/or classroom staff are responsible for monitoring ratios.

Parents interviewed stated that they do not have any concerns regarding the facility or staff and reported satisfaction with the care provided.

During the course of the investigation, LPA conducted a walkthrough of the classrooms and observed classrooms operating within ratio. LPA reviewed Staff schedules and reviewed several “classroom daily ratio attendance tracking forms” dated 07/09/26, and 07/10/26.

Based on interviews conducted, documentation reviewed, and LPAs observations, there was no indication or evidence to support the allegations that classroom is operating out of ratio. Based upon the evidence as presented above, the allegation has been determined to be UNSUBSTANTIATED.
