32 | During interview, Director stated that there have been incidents where children have injured others but there haven't been any serious bites or patterns of injuries from any particular child. For children who are known to be more likely to injure others, staff watch them more closely and stay closer to them to intervene more quickly when they recognize the child's triggers.
On 8/14/26, LPA reviewed facility ouch reports which are used to document child incidents, including injuries, which revealed that there were 39 reports documented between 5/13/25 and 8/6/26. Of the 39 reports, 19 involved incidents in which a child hurt or was hurt by another child. Of the 19 reports, there was no more than one incident each month for any child except for one child (C1), who was injured by another child on 4/6/26 and 4/27/26, and the circumstances of each incident were different.
During interviews with staff (S1, S3, S4), S4 stated that a formerly enrolled child was known to hit other children approximately one to three times a week but not any child in particular. S1, S3, and S4 stated that for children who were known to injure other children, they would attempt to prevent the behavior by closely watching and shadowing the child to intervene when their triggers were observed, however S1 and S3 did not indicate that there were any children who repeatedly injured other children.
During interview, Director stated that besides herself, S1) and S3 are qualified to supervise children on their own and that children are never without supervision of herself, S1 or S3.
On 8/14/26, LPA reviewed staff records for the Director, S1, and S3 which confirmed that they are all qualified as teachers and can supervise children alone.
During interviews, all staff interviewed (S1, S3, S4) stated that only the Director, S1 and S3 are allowed to supervise children alone and that there haven't been any incidents where unqualified staff did supervise children alone.
Although the allegations may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated. Appeal rights were provided and exit interview conducted. The Notice of Site Visit must be posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
