32 | On 6/15/2026, the Orange County Child Care Office received a complaint alleging (1) Staff are operating out of ratio (2) Unqualified staff are providing care and supervision. The Reporting Party (RP) stated the following: Staff#1 (S1)’ s classroom was out of ratio, and that when. S1 was covering the front desk, two assistants supervise thirty children.
During the investigation, the LPA interviewed staff members and parents and reviewed pertinent documents.
Regarding allegation (1) Staff are operating out of ratio
During staff interviews, all nine staff members stated that the facility has not been out of ratio. All nine staff members reported that each classroom typically has three teachers assigned. LPA reviewed the timecards for staff assigned to S1's classroom, as well as the children's sign-in and sign-out sheets, and did not observe any concerns. LPA Nunez also conducted unannounced inspections of the facility on May 13, 2026, and May 22, 2026. During both visits, the facility was observed to be operating within ratio requirements.
Regarding allegation (2) Unqualified staff are providing care and supervision
During staff interviews, S1 and S2 stated that whenever S1 covered the front desk, a floater teacher would enter the classroom to provide additional coverage. Staff#6 (S6) stated Staff#7 (S7) would cover S1's classroom when S1 was at the front desk. Both S2 and S3 denied being left alone together with 30 children. LPA Nunez reviewed staff files to verify qualifications and did not identify any concerns.
During the parent interviews, 3 out of 3 parents did not divulge any information pertaining to the allegations.
Based on information gathered from LPA’s interviews with nine staff members and three parents, the preponderance of evidence has not been met. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations (1) Staff are operating out of ratio (2) Unqualified staff are providing care and supervision; therefore, the allegations are UNSUBSTANTIATED.
