children, all 3 years old, for approximately 15 minutes. The investigation consisted of interviews, record reviews, and observations conducted at the facility.
Interviews were conducted with staff. Facility records (children’s files, child directory, child attendance detail, Personnel Record (LIC500), employee timecard, staff sign in/out, and Face-To-Name Transition Sheets) were reviewed for the dates and times noted in the allegation. LPA made observations on 04/22/2026 and 07/01/2026. LPA contacted 10 parents/authorized representatives, of whom 4 responded. Children interviews were attempted but children did not qualify with the Ten Step Investigative Interview. During the on site inspection, LPA observed the classrooms and outdoor areas to follow staff to child ratio.
During the facility record review of the Face-To-Name Transition Sheets, on 04/15/2026, Preschool 2 had 13 children signed in with 1 staff from 8:14-8:20AM, when 4 children were moved to Room 1. On 04/16/2026, Preschool 2 had 15 children signed in with 1 staff from 8:33-8:35AM, when 6 children were moved to Room 1. During staff interview, the director and assistant director stated the director and assistant director do not sign the Face-To-Name Transition Sheets when entering/leaving the classrooms. The director and assistant director do not recall if they were in Preschool 2 on 04/15/2026 between 8:14-8:20AM nor 04/16/2026 between 8:33-8:35AM.
Information obtained during interviews did not corroborate the allegation. Staff consistently reported that required ratios (1:12 children) were maintained throughout the day. When a 13th child is brought to the classroom, teaching staff call the office staff (director and/or assistant director) to request to move the 13th child to another room or for additional staff to be sent to their classroom. On 04/23/2026, the facility director and assistant director have been making sure they are signing the Face-To-Name Transition Sheets. Staff have asked or have witnessed parents/authorized representatives stay in the classroom with the child until the additional staff arrives. The FR conducted a training on 04/23/2026, to review facility protocol regarding staff to child ratio. During the LPA observations, staffing ratios were found to be within Title 22 requirements.
Although the allegation may have occurred or is valid, based on the information obtained, there is not a preponderance of evidence to substantiate the allegation. Therefore, the allegation of staff out of ratio is deemed UNSUBSTANTIATED. |
