During the investigation, LPA Garcia reviewed the Guardian records. The facility received a Conditional Exemption Approval for Staff #1 (S1) on June 8, 2026. LPA also reviewed the facility’s Guardian roster, which reflected that Staff #1 was disassociated on 04/14/2026 and listed as “in process” from 04/29/2026 to 07/28/2026. Guardian issued an additional notice to Staff #1 on July 22, 2026 titled “Incomplete Fingerprint Submission Reminder.” The Director and Staff #1 stated they did not receive the July 22 notice from Guardian; however, Director was unable to provide a roster or proof showing that Staff #1 had a criminal record clearance in Guardian prior to working at the facility.
During today visit 07/28/2026, LPA also printed the July 22 notice letter from Guardian and provided to the director and S1.
Based on LPA’s interviews and record review, the preponderance of evidence has been met; therefore, the allegation that licensee does not ensure that a staff has a criminal record clearance is Substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1 Section 101170 (e)(3) Criminal Record Clearance is being cited. See LIC 9099D for the deficiency cited. LPA provided director with the Title 22 regulations Sections 101170 for reference.
Exit interview conducted and report was reviewed with the director, Jenny Vasquez. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
