32 | During the investigation, LPA toured the facility on 4/30/2026, 5/4/2026 and 5/13/2026, conducted classroom and playground observations, reviewed 3/2/2026 to 4/28/2026 Incident/Accident Report for Parent/Guardian, and Week 4/20/26 Daily Playground Inspection sheets for Room 7 (seven). LPA also conducted interviews with the reporting party, 5 (five) staff, and 5 (five) parents. LPA attempted to interview 4 children, but they were not qualified for an interview.
On 4/30/2026, 5/4/2026 and 5/13/2026, LPA toured facility with Director Veronica Gonzalez. During inspection on these dates LPA observed staff caring for children and supporting children in the classroom and in the playground. In the LPA observations staff reminded children to walk, slow down, and put toys back in shelves.
During staff interview, staff stated they have conversations with each other regarding children in the facility and how their day is going when supervising children in facility.
On 04/30/2026, LPA conducted parent interviews. LPA called 10 parents and LPA was able to interview 5 parents. One (1) parent stated they saw staff chitchatting with each other outside without supervising the children. One (1) parent stated their child had a mark on the upper eyebrow and staff thought maybe their child fell; the staff didn't really know what happened. One (1) parent stated they had concerns about sand and cement in the playground. Their child has fallen in playground multiple times.
Based on LPA’s observations and interviews conducted with the staff and parents, the preponderance of evidence has been met; therefore, the allegation of Day care child sustained injuries due to staff neglect is Substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1 Section 101229(a)(1) Responsibility for Providing Care and Supervision Type A violation is being cited. See LIC9099D for deficiency cited.
Exit interview conducted and report was reviewed with Assistant Director Brenda Ramirez. The Assistant Director was informed that the “Notice of Site Visit” must be posted on or adjacent to the door for 30 days. Failure to post will result in a Civil Penalty of a $100.00.
