The Reporting Party (RP) stated that on 06/12/2026, Staff #1 (S1) and Staff #2 (S2) spanked children and that staff sometimes take children to the bathroom to spank them so other children will not see. The RP further reported that staff pinch children’s cheeks, yell at the children, and use a loud sound producing device near children’s ears to stop them from talking.
During the investigation, LPA Lucero conducted interviews with staff, children, and parents.
Staff denied all allegations. They stated they do not spank or pinch children and have not witnessed any other staff engaging in such conduct. Staff reported that they recently obtained a handheld wooden chime provided by a program, which is used to gain children’s attention. Staff stated they use it when children are being too loud or during transitions (e.g., going outside, nap time, or meal times). Staff stated the chime produces a soft bell like sound and is used only occasionally. Staff denied ever misusing the chime by holding it near a child’s ear.
LPA interviewed children. Children denied ever being spanked or pinched by staff and denied witnessing other children being spanked or pinched. They also denied that staff have ever held the wooden chime near their ears and reported that the chime does not scare them. Children noted that the pool alarm can be loud and may startle some children, but stated the wooden chime is not frightening.
Parents interviewed stated they did not have any concerns regarding the facility.
Based on the information obtained through interviews, there is insufficient evidence to support the allegations stating (1) staff spank and pinch day care children and (2) staff yell and use a loud device in children's ears to prevent talking. Although the alleged violations may have occurred, the evidence does not meet the preponderance standard required to substantiate the claims. Therefore, the allegations are determined to be unsubstantiated.
