The Reporting Party (RP) reported that Child 1 (C1) disclosed that another child (C2) touched C1 in their private area.

As part of the investigation, LPA Lucero conducted interviews with staff members and parents.

LPA interviewed the parent of C1. The parent stated that C1 informed them that C2 had touched C1’s “private area” while outside on the playground. The parent reported that C1 told them they had notified a staff member (S1) of the incident. The parent stated they did not have an exact date for when the incident occurred.

During the interview with the Director, Mr. Martinez acknowledged he had been notified of the alleged incident by C1’s parent. Mr. Martinez explained that the parent was very brief and did not give much information in regards to the allegation. Mr. Martinez stated he also interviewed staff to determine if anyone had observed the incident; staff reported they had not witnessed anything of concern. Mr. Martinez also reviewed camera footage for the entire week in question, as no specific date was provided. He stated that the only recorded interaction between C1 and C2 occurred on April 29, 2026, during outdoor play time. Mr. Martinez described that the children briefly crossed paths on the jungle gym for approximately three seconds before C1 proceeded down the slide.

Mr. Martinez provided the video footage for LPA review. Due to structural obstructions from the jungle gym, LPA was unable to clearly observe the interaction between C1 and C2. LPA observed that after sliding down the slide, C1 stood up and continued running and skipping around the playground.

Staff interviewed denied witnessing the alleged incident. Staff confirmed they had been informed of the allegation by the Director. Staff reported they had not observed any inappropriate or concerning behavior from C2. Staff also explained after the alleged incident, Mr. Martinez informed staff to be vigilant of C2. Staff also stated that C1 and C2 are not in the same classroom and only come together during snack time after nap time or during outdoor play. S1 denied being informed by C1 of any such incident and recalled C1 only expressing that they were upset about another child knocking down their building blocks.

LPA interviewed parents, and the parents interviewed reported no concerns regarding the day care.

LPA attempted to interview the children; however, the children were not qualified for interviews.

Based on the information obtained during the investigation, there is no preponderance of evidence to support the allegation that child was touched by another child inappropriately. Although the allegation may have occurred or may be valid, there is insufficient evidence to determine whether the alleged violation did or did not occur. Therefore, the allegation is determined to be Unsubstantiated.

Exit interview was conducted with Director Jose Martinez. The Notice of Site Visit was posted.

End of Report.
