32 | During interviews conducted with facility staff members, it was stated that Child#1 wanted to consume their water during outdoor play time but attempted to take their water bottle with with them outside the designated area for consuming water. During interviews, it was stated that Staff#1 had to take the bottle from Child#1 to enforce the classroom policy of consuming water in a designated area during outdoor playtime. During interviews, it was mentioned that Staff#1 asked Child#1 to give back their water bottle after they finished drinking their water. It was also stated that in interviews that Child#1 was upset because they wanted to carry their water bottle with them outside the designated area, and not because they were being denied water. During the investigation, LPA Lee attempted to interview Child#1 who mentioned in the allegation. Interviews with parents of currently enrolled children in care were also attempted and conducted by LPA Lee.
While it is possible that the facility did not meet a child in care's needs by denying Child#1 water. It is also possible that facility staff only asked Child#1 to return their bottle in order to prevent the child from walking away from the designated drinking area during outdoor playtime.
Therefore, the Orange County Regional Child Care Licensing Office has investigated this complaint alleging that facility staff did not meet child's needs. Although this allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is found to be unsubstantiated.
The notice of site inspection must remain posted for a period of 30 days during hours of operation. Failure to maintain this posting requirement may result in a civil penalty $100.00 dollars.
