The Orange County Childcare Office received a complaint on 08/17/2026, with one allegation (1) Staff are operating the facility out of ratio.
During the investigation LPA interviewed five staff, interviewed three parents, and made observations.
Reporting Party (RP) alleges staff are operating the facility out of ratio. RP mentioned observing a teacher in the classroom providing care to 15-16 children alone during nap time. RP was informed of regulation 101230 Activities (c) A teacher-child ratio of one teacher supervising 24 napping children is permitted provided that the remaining teachers necessary to meet the overall ratio specified in Section 101216.3(a) are immediately available at the center. RP then stated they observed a child get off their cot during nap time and roam around the classroom trying to wake other children up from their nap. RP also mentioned observing a teacher with more than 12 children with an assistant but sometimes the assistant will leave the classroom, leaving the teacher alone with more than 12 children. On 08/18/2026, LPA interviewed five staff, all staff had knowledge of teacher-child ratio regulations. All staff interviewed stated they have not been out of ratio or witnessed other staff being out of ratio. Staff interviewed stated during nap time, if children cannot sleep, children are provided with a quiet activity such as a book, coloring book, or toy from home. Staff also mentioned, if they have more than 12 children with an assistant, they call for another staff to step in before one of the staff exits the classroom to remain in ratio.
RP stated observing the facility being out of ratio at 11:30 AM and between 1:00 PM – 2:35 PM. On 08/18/2026, LPA arrived at the facility and toured the classrooms at 2:00 PM. On 08/25/2026, LPA arrived at the facility and toured the classrooms at 11:35 AM. During both visits, it was determined the facility was operating within its licensed capacity and within compliance with staffing ratios.
On 08/21/2026, LPA conducted parent interviews as part of the investigation. LPA attempted to contact six parents via telephone. Out of the six parents contacted, three parents were available and agreed to participate in interviews. The parents interviewed did not provide any information related to or supportive of the allegation.
Child interviews were not deemed necessary to gather additional relevant information.
