32 | The Licensing Program Analysts (LPAs) Samuel Lopez and Eric Ramos investigated the above allegations and gathered the following information: For the last several weeks, leading up to April 10, 2025, which was the last day the licensee provided care for children, the licensee had been observed dozing off on the couch, or zoned out, during pick up times. Licensee was having a hard time walking and needed the use of a cane or a walker due to falls that they had suffered. Licensee would not wake up to receive children and parents/legal guardians would wait up to an hour until the licensee’s assistant would arrive to open the door. Licensee was calling parents/legal guardians by different names even though their children had been in care for some time. On a few occasions, during the last few weeks, the licensee had been observed drinking wine, and then wine mix with diet Coke. One of the licensee’s assistants had been observed slurring their words and smelling like alcohol. Bottles of wine were being delivered at the facility during the hours of operation. The licensee then abruptly ceased proving care and supervision for children after April 10, 2025. The Department was informed of concerns regarding the health status of the licensee and that the licensee had been drinking while providing care for the children, due to having a hard time keeping up with the children and which caused stress. Information was also obtained that the licensee had sought professional help to assist them with these concerns. Licensee denied ever drinking during the hours of operation.
The licensee had been assisted at the facility by a long time assistant but, most recently, around March 2025, had hired a new assistant. The assistant helped the licensee for few hours during the day, for weeks leading up to April 10, 2025, when the licensee stopped providing care for children. Also, the licensee had another assistant, during the previous year and up until November 2024, that in April 2024, helped the licensee again, with the care of the children, on two separate days. These two assistants never obtained a Criminal Record Clearance, as required, in order to provide care for children and assist the licensee. Per Licensee's own admission, the were only aware of one uncleared assistant and denied any other.
In the morning, upon arriving at the facility, some of the younger children were placed inside highchairs to be fed breakfast. After they were done eating, they were left there, given a toy to play with for 30 to 45 minutes, until all the other children were done eating and/or ready for transition to the outdoor play area/backyard. Other times the children were left inside of the highchairs, by the licensee, until the assistant arrived, and to better manage all the children present at the time. Licensee denied the use of high chairs for other than feeding children. They disclosed the use of a high table for play and crafts. |
