On June 13, 2024, at 1:50 p.m., Licensing Program Analyst (LPA), Cindy Hamilton met with licensee Marichel Diaz to deliver the findings for the above stated allegations.  During the investigation, LPA Hamilton conducted interviews with three staff and the reporting party.  LPA Hamilton conducted a health and safety inspections of the CCC on April 3, 2024 and May 1, 2024, and no safety concerns were noted.  LPA obtained copies and reviewed pertinent documentation from facility and children’s records. LPA Hamilton was unable to interview the child(ren) identified as witnesses and/or “victims” due to the child(ren)’s parents denied LPA’s request to conduct interviews.

On March 27, 2024, Community Care Licensing (CCL) received information stating provider is operating out of ratio and provider does not ensure day care children are provided a safe environment.  It was alleged that provider operates out of ratio, and therefore school-age children are being taken to a park for a couple hours to maintain ratio at FCCH after being picked up. Confidential interviews disclosed that a few of the school age children were occasionally taken to a park, however,

children were always supervised by a qualified adult. In addition, confidential interviews revealed to LPA that the FCCH usually has a maximum of 10 children present at one time and never 14 or more. LPA was unable to interview children identified as witnesses to further corroborate this allegation. LPA observed FCCH on multiple occasions and FCCH was operating with Title 22 regulations regarding ratio.

Regarding the allegation provider does not ensure day care children are provided a safe environment, it was alleged that the front door to the facility was kept unlocked on multiple occasions. A confidential interview disclosed that the licensee was leaving the front door open during day care hours; However, further interviews revealed that the licensee stopped doing so due to a recent issue at the facility and was required by CCL to keep the door locked and had an alarm chime installed for security purposes. The licensee also indicated that she meets parents at the door for arrival and departure of children in care to ensure she makes contact with the parents and children are safely dropped off and/or picked up. The licensee denied allegation and stated that she ensures that the daycare is locked at all times during operating hours.

Based on confidential interviews and record reviews, the allegations that provider is operating out of ratio and provider does not ensure day care children are provided a safe environment, may have occurred, however are not supported or proven by evidence. Therefore, the allegations are unsubstantiated.

An exit interview was conducted, a copy of this report, appeal rights and Notice of Site Visit were provided to licensee Marichel Diaz and the licensee was reminded this notice must be posted for 30 days.
