32 | The Licensing Program Analyst (LPA) Samuel Lopez investigated the above allegations and gathered the following information: LPA Lopez learned that other agencies contacted the licensee and investigated the allegations. The Licensee denied the allegations to all. Licensee also added that the allegations were false and believed that they were made by a previous roommate that was upset and was being vindictive because the licensee had evicted them. LPA requested to interview the licensee’s children in hopes of obtaining additional information however, the licensee denied the request. LPA Lopez was not able to conduct interviews with all pertinent parties, as the licensee did not provide documentation that is required by, Community Care Licensing Title 22 regulations, to be in possession of the licensee and at the facility for review. Instead, the licensee handed over her facility license and requested to permanently close. Due to the lack of cooperation by the licensee, LPA was not able to contact current or previous clients, to obtain information of the day to day operation and care being provided at the facility.
Although the allegations of Lack of Supervision and Personal Rights may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.
An exit interview was conducted, and the report was reviewed with the Licensee Norma Madain. |
