On April 14, 2025, at 9:45 a.m., Licensing Program Analyst (LPA) Courtnee Peebles met with Licensee Jessica Whalen to deliver the findings regarding the above-mentioned allegations. During the investigation, LPA Peebles conducted interviews with three parents and two staff members, and reviewed various relevant documents related to the complaint.

The investigation stemmed from a complaint received by Community Care Licensing (CCL) on February 19, 2025, alleging that Child #1 (C1) sustained unexplained injuries while in care, that the Licensee failed to provide adequate supervision, and that the Licensee restrained another child, Child #2 (C2), inappropriately. Regarding the first allegation, it was reported that C1 would often go home with new scratches or bruises, and facility staff were unable to explain how the injuries occurred. Interviews revealed that some children engaged in rough play, which sometimes led to injuries. There was an instance where a parent conflict arose due to concerns over these injuries. LPA reviewed text messages, memos, and photos that corroborated reports of children being hurt during peer interactions.

Staff interviews indicated that due to the size of the family child care home (FCCH) and the fast-paced nature of the environment, not all incidents are witnessed; however, most situations are quickly identified and addressed.

Regarding the second allegation of inadequate supervision, interviews indicated that there are typically two staff members are always present with the children. In situations where a second staff member is unavailable, the Licensee informs parents and requests that they find alternative care until adequate staffing is restored.

The third allegation involved the Licensee allegedly restraining C2 by placing her legs over the child's legs during circle time to prevent them from getting up. Interviews indicated that C2 tends to be very active and noncompliant with group activities. Some interviewees mentioned that the Licensee has joked about needing a seatbelt to keep C2 in place. When C2 is active and noncompliant, the Licensee will call the guardian to help calm the child during particularly difficult moments.

Based on the confidential interviews conducted, LPA's observations, and record review, the allegations that C1 sustained unexplained injuries, that the Licensee failed to provide adequate supervision, and that the Licensee restrained a child while in care may have occurred; however, they are not supported or substantiated by the evidence. Therefore, these allegations are deemed unsubstantiated.

An exit interview was conducted, and a copy of the report, along with appeal rights, was provided and discussed with Licensee Jessica Whalen.
