An informal office meeting was held at Lewis Family Child Care on March 30, 2022 at 1:15 PM. Present at the meeting were Licensing Program Manager (LPM) Pauline Beschorner, Licensing Program Analysts (LPAs) Andrea Taylor and Jessica Rubio, and the licensee Amanda Lewis and husband Matt Lewis. The purpose of the office meeting was to discuss several noncompliance issues with the facility. LPM Beschorner discussed the following issues pertaining to deficiencies recently cited on the previous facility number 334845484:

1) Concerns were discussed regarding the hiring of and presence of employees in the facility without proper criminal record clearances and/or exemptions.
2) Concerns with the facility not operating in the appropriate ratio and capacity were discussed due to the facility being observed to be operating out of ratio and above capacity on 12/22/2021. It was specifically discussed that the licensee must abide by the capacity and ratio as well as ensure personnel requirements are being met and that assistants are qualified.
3) It was also discussed that the facility needs to provide a safe & healthy environment for the children in care which includes, but is not limited to prohibiting smoking on the premises and the use of safe toys and play equipment, such as the trampoline.

Ms. Lewis provided the following information during meeting:

Regarding the criminal record clearances and/or exemptions, the licensee disclosed the current staff that will be working in the facility are already cleared and licensee agreed that she would ensure that moving forward all employees will have a criminal record clearance and/or exemption prior to working in the facility.

Regarding the capacity and ratio issue Ms. Lewis explained moving to this new facility she has lost school aged children and will ensure that the facility is not out of ratio or over capacity. Licensee also disclosed she will turn down potential clients to ensure she is not operating over capacity. (Continued on LIC 809-C)

Regarding smoking in the family child care home and presence of tobacco products, the licensee denied anyone smokes in the facility and no products were in the presence of children and in her personal bedroom not accessible to children. Regarding the trampoline, the licensee stated the trampoline is no longer being used for the children in care and is for personal use only. The ladder to the trampoline will never be present when there are children in care.

It was also discussed during the meeting:
The licensee shall be present in the family child care home so that children are supervised at all times as well as the licensee being available for licensing representatives within a reasonable time, approximately 20 minutes, should they arrive to the facility. It was discussed licensee should also communicate to the LPA regarding any prolonged absence from the facility and shall arrange for a substitute adult to care for and supervise the children.

It was explained to the licensee that a Non-Compliance Conference will be scheduled prior to the issuance of a license. Licensee was also notified that due to the above discussed issues the Department will visit the new facility more frequently to verify compliance and if the facility is found to be operating in violation of regulations, the Department will pursue expedited revocation of the license.

An exit interview was conducted, and a copy of this report was issued to Amanda Lewis.
