At approximately 11:30AM Licensing Program Analyst (LPA) Michelle Perez, met with Director Brenda Fitz-Hoisington on December 19, 2023 for the purpose of opening a complaint investigation. LPA observed 4 children in care, supervised by the licensees.
It was alleged that the licensee made inappropriate comments regarding a day care child.

LPA interviewed the licensee and found that an interview took place with a "potential" new family/guardian and their child, with the licensee and the child had never been enrolled in care. During the interview, the child was sitting apart from guardian and licensee, while questions were asked regarding the child. Licensee stated, that the child was sitting separately on a nearby couch, facing the television while watching a show. During this time the licensee spoke to the guardian to ask questions. Throughout the conversation, licensee and guardian shared information about the child and when speaking about specific topics no words were spoken, but instead were spelled out. Guardian answered all questions and volunteered information about child to the licensee.

Per the licensee, the child never turned to acknowledge the conversation between guardian and licensee, and continued to watch television. Guardian continued to speak with licensee and did not indicate there were any concerns with the conversation. Licensee explained that interviewing a family, in-person was necessary to have a better understanding of the child's needs

Licensee reached out to guardian to see if they were still interested in care. Guardian stated they were uncomfortable continuing with seeking care at the facility because of questions asked. Guardian did not feel that certain questions should be asked in an interview, while seeking childcare. Licensee explained that the questions were not meant to make anyone uncomfortable, but to provide insight on the child and how to best provide care. Licensee also explained that the child was unaware of the conversation, as the child continued to watch television while sitting apart from the guardian. No questions were asked directly to child. Guardian did not respond any further.

Based on the information obtained during the interviews, LPA could not find enough information to substantiate the complaint. LPA did not find any information that would lead to the child's personal rights violated or dignity not being afforded or any embarrassment that may have been caused with the child.

Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore all allegations are unsubstantiated.
