On Thursday, April 13, 2023, Licensing Program Analysts (LPAs) Amanda Sutter and Soleil Marx met with Licensee, Xiaoping McClara, for the purpose of an unannounced annual inspection. Upon arrival, LPAs observed 3 children supervised by the licensee. All individuals subject to criminal background review have obtained a criminal record clearance. LPA observed proper ratio and capacity was being followed. Facility hours of operation are Monday through Thursday from 7:30 AM to 5:00 PM.

On 2/17/2023, Licensee submitted an application for a capacity increase from 8 to 14 children. The Fire Safety Inspection Clearance has been received from the Sacramento City Fire Department on March 23, 2023 and the home has been cleared for up to 14 children. Large family child care home capacity limitations were reviewed during today's visit. Licensee acknowledges that when there is no assistant present, facility will revert back to the small capacity. Licensee acknowledges that children residing in the home under the age of 10 years shall be included in capacity.

A health and safety evaluation was conducted in all areas accessible to children. Off-limit areas include: office, backyard, and adjacent building. Licensee acknowledged that children may never enter these off-limit areas. LPA observed that the facility is clean, safe, sanitary, and in good repair. LPA observed a functioning smoke detector, carbon monoxide detector, and a full 2A10BC fire extinguisher. The facility has adequate toys that appear to be safe for children to use. Licensee stated there are no weapons or poisons in the home. The front yard play area is fenced.

LPAs reviewed two child file which was observed to be complete. Required postings and the children’s roster were observed. Fire drill log was observed. The last fire drill was conducted 12/7/2022. Licensee’s CPR/First Aid card has an expiration date of 11/13/2023. Licensee’s mandated reporter expires 11/17/2023.

LPAs verified that the annual fees are current. LPAs provided the Child Care Advocates Program email address: [email protected], so the licensee can request to be added to the distribution list to receive Quarterly Updates.

LPAs discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPAS also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Service (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Effective today, April 13, 2023, LPAs will approve the capacity increase to serve up to either 14 children, two (2) of which must be at least 6 years of age and no more than three (3) may be infants; or 12 children, four (4) of which may be infants. Infants are children under the age of 2.

A notice of site visit was given and must remain posted for 30 days. Based on the inspection, no citations have been issued. Exit interview conducted and report was reviewed with the licensee Xiaoping McClara. Appeal rights were provided.
