On 07/01/2026, Licensing Program Analyst (LPA) Soleil Marx met with Director, Nicole Moran-Estrada, for the purpose of delivering complaint findings for the above allegation. Throughout the course of the investigation, LPA conducted observations of teacher-child interactions, classroom management, and supervision practices. LPA reviewed incident and injury reports, behavior and safety plans, and conducted interviews with staff, parents/guardians, and children.

Through observations and interviews, LPA observed that staff were positioned throughout the activity spaces to maintain visual supervision of all children and the classroom layout provided clear lines of sight, allowing staff to effectively supervise children. LPA observed staff actively monitoring children's interactions, providing redirection when necessary, and intervening appropriately when conflicts arose between children. Staff interviews revealed that behavior and safety plans are implemented and shadowing techniques are utilized to closely supervise children exhibiting challenging behaviors in an effort to reduce the likelihood of harm to other children while maintaining supervision of the entire group.

LPA reviewed records of incident and injury reports and could not verify that injuries sustained to children by other children were a result of staff failing to provide adequate supervision or failing to implement appropriate interventions. Although records and interviews confirmed that incidents between children causing injury have occurred while in care, the documentation and interviews conducted indicate that staff observed the incidents and intervened as quickly as circumstances allowed.

Interviews conducted with children indicated that they feel safe at school and that teachers help resolve conflicts between children. Additionally, interviews with parents/guardians did not corroborate concerns that staff fail to prevent children from harming other children or that the facility had a pattern of inadequate intervention.

The investigation did not produce evidence to prove that staff failed to take reasonable measures to prevent children from causing harm to one another. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegation, therefore the allegation is unsubstantiated.

Exit interview conducted, report reviewed with Director, appeal rights provided. No deficiencies were cited as a result of this investigation. Notice of site visit given and must remain be posted for 30 days.
