32 | (CONTINUED FROM LIC 9099)
Regarding the allegation "The classroom furniture has protruding nails, posing a hazard to children in care", it was alleged that children may have been injured due to exposed nails on classroom furniture. LPA's tour of C1's classroom did not reveal any protruding dangerous implements from any furniture or walls. LPA was unable to find any item in the classroom which was constructed with nails. Interviews conducted with staff indicated there had not been any incidents of children coming in contact with and/or injured by a nail as alleged.
Regarding the allegation, "Staff did not inform the child's authorized representative about the child's incident", it was alleged that C1 was bitten on the nipple area and their responsible party was not informed of the incident. A review of facility records revealed a 6/11/2026 incident report documenting an incident where C1 sustained a cut to the left nipple area received when experiencing a fall into a shelving unit after colliding with another child while running through the classroom. The incident report indicated both Director Sepulveda and Licensee Sejal Patel notified C1's responsible party via telephone and upon pick up of C1 on 06/11/2026, it was documented C1's responsible party refused to sign the incident report. Records reviewed also revealed a second incident report dated 06/11/2026 concerning an additional incident which occurred on that date which was signed by C1's responsible party.
Although the allegations may have happened or are valid, there is no preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated. An exit interview was conducted, and this report was reviewed with and provided to Director Sepulveda. Appeal Rights were also discussed and provided. An LIC 9213- Notice of Site Visit was also issued and must remain posted near the main entrance for 30 days. Non-compliance with posting will result in a $100 fine. This report must be accessible to the public for three years. |
