On 7/21/26 at 1:30 pm Licensing Program Analyst (LPA), Gerald Poindexter conducted an unannounced visit for the complaint received on 5/4/26, for the purpose of delivering findings on the above reference allegations. LPA met with Heidy Balderas, center director. There were 64 children present and napping in 4 classrooms (with one room combined) with 7 staff. Facility is within ratio and capacity.

During the course of the investigation, LPA Poindexter toured classrooms, reviewed facility documents and personnel files, and interviewed the center director, staff members, and parents.

It was alleged by the anonymous Reporting Party (RP) that “staff are operating out of ratio” specifically, during mornings and afternoons. LPA toured preschool classrooms during each daypart, on 5/12/26 and 7/16/26, respectively. Each time, the facility was within ratio and capacity. LPA reviewed staff sign-in sheets, and interviewed staff who identified situations in which a floater teacher or the director rotate into classrooms, as needed, to maintain ratio. Parents interviewed did not observe classes out of ratio during morning drop off or afternoon pick up.

It was alleged that “staff yell at day care children.” The anonymous RP stated that they witnessed staff yelling a command at a child and offered naptime as their example to support the allegation. LPA observed classroom activity and conducted interviews. Staff acknowledged raised voices – not in anger or frustration – but rather, to be heard in the classroom or to redirect children to their cots. Specifically, staff noted room layouts where a teacher attending to child outside the bathroom may raise their voice so that children across the room can hear. Parents interviewed did not express concerns that align with the allegation. The RP presented no additional evidence supporting the allegation.

Based on the interviews, observation, and documentation obtained and reviewed, the LPA determines that the above allegations cannot be proven or disproven. Therefore, they are considered UNSUBSTANTIATED. A finding that the allegation is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.

Exit interview conducted and report was reviewed with Heidy Balderas, center director. A Notice of Site Visit was given and must remain posted for 30 days. Appeal Rights provided.
