On 7/21/26 at 2:45 pm Licensing Program Analyst (LPA), Gerald Poindexter conducted an unannounced visit for the complaint received on 5/4/26 for the purpose of delivering findings on the above reference allegation. LPA met with Heidy Balderas, center director. There were 14 infants present in 2 classrooms with 4 staff. Facility is within ratio and capacity. During the course of the investigation, LPA Poindexter toured classrooms, reviewed facility documents and personnel files, and interviewed the center director, staff members, and parents.

It was alleged by the anonymous Reporting Party (RP) that “staff are operating out of ratio” specifically, during mornings and late afternoons. LPA toured infant classrooms during each daypart, on 5/12/26 and 7/16/26, respectively. Each time, the facility was within ratio and capacity. LPA review staff sign-in sheets, and interviewed staff who identified situations in which a floater teacher or the director are called to rotate into classrooms, as needed, to maintain ratio. Parents interviewed did not observe classes out of ratio during morning drop off or afternoon pick up.

It was alleged that “Staff do not ensure the center is free from pests.” The anonymous RP stated that they witnessed mouse droppings in various classrooms, including the infant rooms. LPA toured the facility and did not observe evidence of mice. The LPA observed hidden rodent entrapment devices placed behind and underneath baby cribs and other equipment. LPA was also provided with recent pest control vendor invoices for general service and later, an invoice for “extra service” in response to a rodent sighting in a closet. Ms. Balderas stated that capture devices are installed and checked as part of scheduled and as-needed maintenance. She noted that there has not been a nuisance or infestation level that is harmful to children in care. LPA conducted interviews with additional staff and parents – none of whom identified a rodent problem.
Based on the interviews, observation, and documentation obtained and reviewed, the LPA determines that the above allegations cannot be proven or disproven. Therefore, they are considered UNSUBSTANTIATED. A finding that the allegation is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.

Exit interview conducted and report was reviewed with Heidy Balderas, center director. A Notice of Site Visit was given and must remain posted for 30 days. Appeal Rights provided.
