32 | Co-licensee, Sanchez and Del Toro were arrested together, as they attempted to evade law enforcement on foot. On the same date, 1,221 grams of marijuana and approximately $412,730 in U.S. currency were seized from the facility property. Del Toro and Cosios were subsequently convicted of felonies related to their arrests; co-licensee, Maria Sanchez was not convicted. During interviews conducted by IB investigators, co-licensee, Sanchez, made false statements by stating that she was never investigated, nor arrested.
Based on co-licensees’ admissions and law enforcement record review, it was determined that Del Toro resided in the facility from 2013, until his arrest in 2018, without a criminal record clearance as required. A review of licensing records revealed that co-licensee, Sanchez did not designate Del Toro as a resident of the facility on the Application for a Family Child Care Home License form (LIC279), which was signed by Maria Sanchez on March 19, 2013, and received by the Department on March 21, 2013. Both co-licensees denied that Cosios ever resided in the facility, explaining he will visit the facility after daycare hours.
Based on interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. Two (2) Type A deficiencies under California Code of Regulations, Title 22, Division 12 & Chapter 3, are being cited on the attached LIC 9009D. A $500 civil penalty will be assessed for criminal record clearance violation.
Upon receipt of report licensees, Maria Sanchez and Damaris Lopez, are notified that this report dated 08/10/2023 documents two (2) Type A citations which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
Also, upon receipt of report licensees are notified to provide a copy of this licensing report dated 08/10/2023 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. |
