13 | On June 2, 2022 at 9:20 AM, Licensing Program Analyst (LPA) Jo Ann Legaspi conducted an inspection to conclude the licensing investigation regarding the above allegations. LPA advised Licensee Maria Hernandez of the inspection's purpose and she granted LPA facility entry. Present in the home was the Licensee, one (1) staff member, and two (2) children aged 2 - 2 1/2 years.
The investigation involved unannounced facility tours, staff - children observations and record reviews. The investigation also comprised of interviews with witnesses, children, parents, staff and the Licensee.
The Licensee denied children are confined in highchairs for an extended period of time or directly nap on the floor. Due to conflicting statements, the allegations children are confined in highchairs for an extended period and nap directly on the floor have been determined to be unsubstantiated. A finding that the complaint is Unsubstantiated means that although the allegations may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.
