On 01/12/22 at 11:45 a.m., Licensing program Analyst (LPA) Rajani Goudreau, made an unannounced complaint visit for the purpose of delivering the complaint finding for the allegation listed above. Upon arrival LPA met with licensee, Sofia Salazar Lopez, and proceeded to tour the facility. During the visit there were 12 children in care with two staff members present. During the course of the investigation, LPA obtained and reviewed facility records, and interviews were conducted with day care parents, children in care, licensee, staff, and outside agencies

On November 16, 2021, Community Care Licensing (CCL) received a complaint alleging the facility was operating over capacity. During an interview with licensee, licensee admitted to exceeding the licensed capacity of 14 children on September 22, 2021. Based on documentation on file reflecting licensee’s certification on YMCA and CDA (Child Development Associates) claim forms, there were 15 to 19 children in care at one time between the hours of 9:00 a.m. to 4:00 p.m. on September 22, 2021. The preponderance of evidence standard has been met; therefore, the above allegation is found to be substantiated. California Code of Regulations, (Title 22, Division 12 & Chapter 3) is being cited on the attached LIC 9099D.

LPA, Rajani Goudreau, informed licensee that this report dated January 12, 2022 document(s) one type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.

LPA, Rajani Goudreau, also informed the licensee to provide a copy of this licensing report dated January 22, 2022 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Licensee stated she will submit an updated facility roster and a detailed schedule that outlines the times and dates daycare children will be present in the facility. In addition, licensee stated she will submit a written plan to reflect what measures will be put into place to prevent the facility from operating over capacity in the future.
