25 | On 10/24/2024 at 2:45pm, an office meeting was conducted to discuss a deficiency cited on 9/13/2024. Present at the meeting was Licensee Representative, Shady Estrada and her husband Isai Estrada; Licensing Program Managers (LPMs) Cynthia Biszant and Jason Garary and Licensing Program Analysts (LPAs) Adrian Castellon, Danielle Anderson and Saul Zazueta.
During a Required - 3 year inspection conducted on 9/13/2024, Licensee advised LPAs Castellon and Anderson that she was not residing in the licensed home. Licensee stated that she had moved next door to the licensed home. Licensee did not advise the licensing office. LPAs observed that both bedrooms in the home were used exclusively for daycare purposes. Licensee did not maintain a bed in the facility.
LPAs conducted a Plan of Correction inspection on 09/25/24 to ensure that licensee had moved back into the licensed home. LPA Anderson inspected licensee's bedroom and the facility bathroom. There was a day bed and night stand located in the bedroom. LPA Anderson checked bathroom and observed personal hygiene items, hair care products, and other personal items. LPA Anderson also inspected bedroom closet and observed adult clothing and shoes.
LPM Biszant and LPA Castellon discussed Title 22 regulation 102352(f)(1) which defines Family Child Care as regularly provided care, protection, and supervision of children, in the care giver's own home for periods of less than 24 hours per day while the parents or guardians are away. LPM and LPA also reviewed Health and Safety Code 1596.78(a) which states "'Family day care home' means a home that regularly provides care, protection, and supervision for 14 or fewer children, in the provider's own home, for periods of less than 24 hours per day, while the parents or guardians are away, and is either a large family day care home or a small family day care home". Licensee was advised if she were to relocate, a change of location application must be submitted. If licensee were to relocate without submitting the application, the license would be considered forfeited per Health & Safety Code 1596.858. Regulation 102416.3 Alterations to Buildings or Grounds was also discussed and provided on this date. |
