13 | On 02/21/24 at 4:00PM, Licensing Program Analyst (LPA) Luigi Gargaro conducted an unannounced complaint visit to the facility to deliver the findings for the above allegation. During the course of the investigation, analyst conducted interviews with the reporting party, the licensee and her spouse, her facility assistant, children in care, day care parents and additional collateral interviews.
Based on the information gathered, it could not be conclusively proved or disproved whether an adult in the home pulled a day care child's ear as there was conflicting testimony as to what occurred and no corroborating witnesses or other evidence to definitively confirm or refute the reported action.
Though the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.
An exit interview was conducted and the report was reviewed with licensee Ladiya Bahati. A copy of this report, along with Appeal Rights (LIC9058 01/16), were provided. A notice of site visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
