| The Department conducted multiple visits to the facility throughout the course of the investigation. During each visit, the facility was observed to be operating within ratio, and appropriate supervision of children was observed.
Interviews were conducted. No corroborating details were provided to support that inappropriate interactions between children occurred. Statements obtained consistently indicated that staff did not witness or have knowledge of the alleged incident.
The facility provided documentation attesting to its communication practices, including multiple injury reports given to parents, demonstrating that the facility does communicate incidents to responsible parties when they are aware of them. The facility reported that they were not aware of the alleged incident at the time, which is why no report was made.
The licensee representative reported that video footage had been reviewed; however, the footage was not able to be provided to the Department due to routine automatic deletion conducted by the facility’s security system.
At this time, the information available consists only of an isolated statement asserting the incident occurred and the interviews indicating it did not. No physical evidence, documentary evidence, or witness statements were obtained that could confirm the incident.
Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred. Therefore, the allegation is determined to be UNSUBSTANTIATED.
An exit interview was conducted and the report was reviewed with Wendy Hernandez. A Notice of Site Visit was provided and must remain posted for 30 days. Appeal rights were provided.
