On 07/27/2026, at 9:45 AM, Licensing Program Analyst (LPA) Jennifer Irving conducted a complaint visit to deliver findings regarding the following allegation: facility wrongfully dismissed a day care child.

During the course of the investigation, LPA conducted interviews with relevant parties and reviewed facility records and documentation, including incident reports, written notices provided to the child’s authorized representatives, facility policies, and information regarding the child’s attendance and behavior while in care.

It was alleged that the facility wrongfully dismissed a day care child, identified as Child #1, from the program. During the investigation, LPA conducted interviews regarding the circumstances leading to Child #1’s dismissal, the facility’s communication with Child #1’s authorized representatives, behavioral concerns documented by the facility, and the actions taken by staff prior to terminating care. obtained during interviews indicated that Child #1 had been involved in multiple behavioral incidents while attending the facility. Facility records documented multiple incidents since January. The documentation showed that staff responded to several incidents through redirection and other classroom interventions. The facility also provided written communications to Child #1’s authorized representatives regarding ongoing behavioral concerns and the possibility that care could be terminated if the behaviors continued.

Child #1’s authorized representative disputed whether the facility provided sufficient support or followed an appropriate process prior to dismissing Child #1. The authorized representative also reported concerns regarding the frequency of requests to pick up Child #1 early and stated that Child #1 had not experienced similar behavioral concerns after enrolling in another program.

Although the parties provided differing accounts regarding the support provided to Child #1 and the circumstances surrounding the dismissal, the information obtained did not establish that the facility dismissed Child #1 in violation of applicable licensing requirements or the facility’s written policies. Records reviewed showed that the facility documented behavioral concerns, communicated with Child #1’s authorized representatives, and provided notice.

Based on the information obtained during the investigation, the Department was unable to determine that the alleged violations occurred. Although the allegations may have happened or may be valid, there is not a preponderance of the evidence to prove the alleged violations occurred; therefore, the allegations are UNSUBSTANTIATED. An exit interview was conducted, and the report was reviewed with Shannon Spencer and Gia Aguilar. A Notice of Site Visit was given and must remain posted for 30 days.
