Licensing Program Analyst (LPA), Melchisedeck Augustin made an unannounced complaint investigation visit and met with Licensee, Therese Alano (LS). LPA previously met with LS on 05/04/22 to initiate the investigation by discussing the purpose of the visit, conducting interviews with children and staff, and requested facility roster of the children currently in care. It is alleged that an adult in the home handled child in a rough manner. The report more specifically noted that on an unknown date, a staff member adult hit a child (C1) with his/her hand.

LPA, Augustin interviewed LS, one staff (S1), four children (C2-C5), three adults (A1-A3), and two parents (P1 & P2) starting from 05/04/22 through 07/28/22. LS statement corroborated the allegation when stating she used her hand to “pat” at least three child(ren) on either the palm or dorsal side of their hand as a method to discipline and/or correct a child’s behavior. In addition, LS sometimes uses a ruler to pat on the wall or a whistle to get the children’s attention which would quiet the children because they knew LS was upset. For example, such method is used when children do not listen when going to the bathroom. (Continue to LIC 9099-C)

Furthermore, according to LS, if a child exhibited an undesired behavior such as scattering food or making a mess during meal time, LS talked with that child many times before proceeding to place a child in timeout for 5-10 minutes, and then patted child on their hands. The discipline the Licensee described in her statement is inconsistent and does not comply with the regulatory requirements of children’s personal rights.

S1’s statement confirmed the facility’s discipline policy consisted of putting a child(ren) in time out for less than five minutes while the LS stated no more than 10 minutes. One statement noted seeing an adult hit a child in the face, while another statement reported a teacher hit a child, although details and timeframes could not be provided.

Based on this investigation, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. The facility did not comply with the requirements of Personal Rights of California Code of Regulations (CCR) 102423(a)(4). Exit interview conducted, and report was reviewed with the Licensee, Therese Alano. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. California Code of Regulations, Title 22, Division 12 & Chapter 01, Article 06, are being cited on the attached LIC 9099D. Appeal Rights were provided.
