Licensing Program Analyst (LPA), Melchisedeck Augustin made a subsequent complaint-investigation visit and met with Licensee, Tamara Reed (LS) for the purpose of delivering finding for the above allegation. LPA previously met with LS on 02/01/23 to initiate the investigation by discussing the purpose of the visit, conducting interviews with LS; and requesting a facility roster of the children currently in care. It was alleged that the Licensee did not ensure that a day care child was picked up from school on a timely basis.

LPA interviewed LS, one parent (P1), and one adult (A1), from 01/27/23 through 03/24/23. LS confirmed she had an agreement with P1 to pick up C1 from an elementary after-school program by 6:00pm on Tues, Wed & Thurs, however; in 2022 and early 2023, LS picked up C1 between two to ten minutes late due to certain circumstances. LS stated she mistakenly thought she was supposed to pick up C1 by 6:15pm, until a school district personnel (A1) from the after-school program reminded LS of the requirement for C1 to be picked up before or by 6:00pm. The statement P1 and A1 provided validated there was an agreement for P1 to drop off C1 at the elementary school, while LS was responsible for picking C1 up from the after-school program by 6:00pm on the days LS specified at which time LS was expected to provide the care and supervision. According to P1, LS was late to pick up C1 from the after-school program once per week on at least ten separate occasions, and to P1’s knowledge, the latest time LS picked up C1 was at 6:30pm which resulted in the school notifying P1 of LS’s tardiness. It was the after-school program’s policy to not release a child until the parent or authorized person designated to pick up the child was at the school. A1 conveyed the after-school program’s regular operating hours were 3:00pm to 6:00pm, and the program’s expectation was for the parent or authorized person to pick up C1 at the side gate area either before or by 6:00pm. A1 confirmed C1 was enrolled in the after-school program, and further explained that on two prior occasions LS picked up C1 from the program between 6:05pm and 6:15pm. Also, in November or December 2022, LS picked C1 up at 6:20pm, which resulted in C1 or a school district personnel having to call LS to find out her location. LS’s tardiness prompted A1 to instruct LS to call the after-school program in advance if LS anticipated being late. This evidence corroborates the claims that LS has picked up C1 late from the afterschool program on multiple occasions when LS had agreed to be available to pick up and provide care and supervision.

Based on LPAs interviews conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 & Chapter 1, Article 06, are being cited on the attached LIC 9099D. Appeal Rights were provided. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the licensee, Tamara Reed.
