32 | Furthermore, LS confirmed she had already accepted the weekly tuition payment from A1 to continue care to C1, and LS agreed to accommodate a change in C1’s schedule following a text that A1 sent on 01/27/23, requesting to change the evening schedule to early morning start to drop off at school. The new terms were due to take effect at the end of February 2023, however; on 02/01/23, following a prior complaint raised to the local licensing agency, LS sent A1 a text to notify of the termination of C1’s contract.
According to A1’s statement, LS sent a text to remind A1 to pay the weekly tuition on 01/29/23 to cover the services provided for the week, and on that same day, A1 paid the tuition which LS accepted. A1 subsequently made a request to change C1’s schedule in which A1 & LS agreed to the terms with a contingency of a tuition increase. LS never told A1 that she did not agree to the new terms, or that she could not provide care after 7:00pm. Instead, A1 received a text stating that C1’s contract was terminated.
